Terms of Service

These Terms govern your use of GhostBot ("GhostBot", "we", "us"), an AI-powered A/B testing service for Shopify merchants. By installing GhostBot on your store or using the admin app, you agree to these Terms and to our Privacy Policy. If you don't agree, don't install or use the service.

01 · The Service

GhostBot drafts experiment variants for your storefront using AI, runs split tests by assigning your visitors to variants, records behavioral analytics on tested pages, and attributes purchases and revenue to variants so you can see conversion and revenue lift.

Variants are applied by a script on your storefront; assignment and event collection run on edge infrastructure; purchase attribution happens server-side from Shopify's orders/create webhook. The personal data involved, and our respective roles, are described in the Privacy Policy and our Data Processing Addendum (available on request).

We may change, add, or discontinue features over time. We'll make reasonable efforts to notify you of material changes that hurt core functionality, and if we discontinue the service entirely we'll give you at least 30 days' notice.

02 · Eligibility and your account

To use GhostBot you must operate an active Shopify store, have authority to install apps on and bind that store, and be old enough to form a binding contract. If you accept these Terms for a company, you represent that you can bind it. The service is for merchants. It is not directed to consumers or to your storefront's visitors.

Installation happens through Shopify OAuth with least-privilege scopes. We store an offline access token (encrypted at rest) to operate on your behalf. You're responsible for the security of your Shopify account and for activity under your store's installation.

03 · AI-generated content and results

GhostBot's hypotheses, variants, and conclusions are automated suggestions, not professional advice or guaranteed outcomes:

• You approve everything. Variants are drafts until you approve them. You're responsible for reviewing and approving what goes live on your store, and for ensuring published content is accurate, lawful, and yours to display. Once published, approved content is your storefront content.
• No guaranteed lift. A/B results are statistical estimates that depend on your traffic and store. Reported lift is an estimate, not a promise.
• AI can be wrong. Outputs may be inaccurate or unsuitable, so review before relying on them.
• No training on your data. We don't use your storefront content or data to train AI models.

04 · Acceptable use

You agree not to (and not to let anyone else):

• use the service in violation of law, Shopify's terms, or applicable Shopify policies;
• test or display content that's unlawful, infringing, deceptive, or not yours to display;
• attempt unauthorized access, disrupt the service or its infrastructure, or circumvent access controls or rate limits;
• reverse engineer the service except where the law says we can't stop you;
• resell or sublicense the service beyond operating your own store(s);
• use the service to collect visitor data beyond what it's designed to collect, or attempt to re-identify its pseudonymous identifiers.

You're responsible for your own storefront's legal compliance, including any privacy notices and consent experiences your jurisdiction requires (see the Privacy Policy for how GhostBot honors Shopify's consent signals automatically).

05 · Fees

GhostBot is free during early access. No card is required.

Paid plans will come later. When they do: we'll give existing merchants at least 30 days' notice before any charge applies, charges will run through Shopify's billing system, and if you don't want to pay you can uninstall before billing starts and owe nothing. Fees, once introduced, will be exclusive of taxes, which are your responsibility.

06 · Your content and ours

• Yours. You retain all rights to your storefront content and to the data we process on your behalf. You grant us a limited license to host and process it solely to provide the service. Approved AI variants become part of your storefront content.
• Ours. The service itself (software, design, documentation) is ours or our licensors'. We grant you a limited, non-exclusive, revocable license to use it for your own store(s) during the term.
• Feedback you send us can be used by us without restriction.

07 · Third-party services

The service depends on Shopify (your platform, under your own agreement with them) and on the infrastructure providers listed in the Privacy Policy. Your use is also subject to those third parties' terms; we're not responsible for their acts or availability except as our DPA provides for sub-processors.

08 · Privacy and data protection

Our Privacy Policy describes what we collect and why. For shopper data processed on your behalf you are the controller and we are your processor; a Data Processing Addendum is available on request at support AT ghostbot.ai. You're responsible for your own controller obligations: lawful basis, storefront notices, and responding to your customers' rights requests (we support the Shopify deletion and access flows automatically).

09 · Term and termination

These Terms apply from your first install until terminated. You can terminate anytime by uninstalling GhostBot. We may suspend or terminate access for material breach, legal requirement, or security risk. On uninstall, your shop record and access token are deleted immediately and remaining data is erased through the Shopify redaction process described in the Privacy Policy. Sections that should survive (IP, disclaimers, liability limits, indemnification, governing law) survive.

10 · Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY EXPERIMENT WILL PRODUCE ANY PARTICULAR RESULT. NO UPTIME OR SERVICE-LEVEL COMMITMENT IS OFFERED DURING EARLY ACCESS.

11 · Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.

EXCEPT FOR YOUR INDEMNIFICATION OBLIGATIONS UNDER SECTION 12, EACH PARTY'S TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100) OR THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

Nothing in this section limits either party's obligations under applicable data protection law, or our obligations as your processor under the Data Processing Addendum.

12 · Indemnification

You'll defend and indemnify GhostBot and its officers, employees, and agents against third-party claims arising from: (a) your storefront content, including AI variants you approved and published; (b) your use of the service in violation of these Terms or the law; (c) your obligations as data controller for your shoppers (notices, lawful basis, consent configuration on your storefront); or (d) your infringement of third-party rights.

13 · Governing law and disputes

These Terms are governed by the laws of the State of Texas, excluding its conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Texas, and both parties waive trial by jury.

14 · Changes to these Terms

We may update these Terms. For material changes we'll update the date above and give notice by reasonable means (in the admin app or by email). Continued use after changes take effect constitutes acceptance; if you don't agree, uninstall GhostBot.
